General terms and conditions of business

1. Scope
The following terms and conditions apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who concludes a legal transaction for purposes that cannot be attributed predominantly to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

These terms and conditions also apply to future business relationships with entrepreneurs without us having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they will only become part of the contract if we have expressly agreed to this.

2. Contracting parties, conclusion of contract
The purchase contract is concluded with Complett:Verlag owner Armin Würfl.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking on the order button. Immediately after submitting the order, you will receive another confirmation by email.

A binding contract can also be concluded beforehand as follows:

If you have chosen to pay by credit card, the contract is concluded at the time the credit card is charged.
If you have chosen to pay by direct debit, the contract is concluded at the time the account is debited.
If you have chosen PayPal as your payment method, the contract is concluded at the time you confirm the payment order to PayPal.
If you have chosen the SOFORT transfer payment method, the contract is concluded at the time of confirmation of the payment order to SOFORT GmbH.
If you have chosen the Giropay payment method, the contract is concluded at the time of confirmation of the payment order to Giropay.
The language available for concluding the contract is German.

3. Delivery conditions
In addition to the stated product prices, shipping costs are also added. You can find out more about the shipping costs in the offers.

You generally have the option of picking up your order from ComplettVerlag/GS MotorradMagazin, owner Armin Würfl, Firmianstraße 27, 94136 Thyrnau, Bavaria during the following business hours: Monday to Thursday 1 p.m. to 4 p.m.

4. Payment
The following payment methods are available in our shop:

advance payment
If you choose to pay in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment.

cash on delivery
If you choose cash on delivery as your payment method, an additional charge of EUR 6.00 will be incurred. An additional EUR 2.00 must be paid directly to the delivery person.

credit card
Your credit card will be charged when the order is completed.

If you choose to pay by credit card, an additional charge of 4 percent of the purchase price will apply.

direct debit
The purchase price will be debited from your account upon completion of the order.

If you choose direct debit as your payment method, you will be charged an additional 0 percent of the purchase price.

SEPA direct debit
If you give us a SEPA mandate, payment will be made by direct debit from your bank account. The account will be debited after the goods have been dispatched. We will inform you separately in advance of the date of the account debit.

The period for your advance information about the date of the account debit (pre-notification period) will be shortened to 1 day.

If you choose SEPA direct debit as your payment method, you will be charged an additional 0.0 percent of the purchase price.

Paypal
You pay the invoice amount via the online provider Paypal. You must be registered there or register first, authenticate yourself with your access data and confirm the payment instruction to us. You will receive further information during the ordering process.

If you choose the payment method Paypal/Paypal Express, an additional charge of 1.99 euros will be incurred.

SOFORT transfer
We also offer SOFORT transfer. We receive the transfer credit immediately. This speeds up the entire ordering process. All you need is your account number, bank code, PIN and TAN. Using the secure payment form from SOFORT GmbH, which is not accessible to retailers, SOFORT transfer automatically sets up a transfer in your online bank account in real time. The purchase amount is transferred immediately and directly to the retailer's bank account. If you choose the SOFORT transfer payment method, a pre-filled form opens at the end of the ordering process. This already contains our bank details. The form also shows the transfer amount and the purpose of the transfer. You now have to select the country in which you have your online banking account and enter the bank code. Then enter the same data as when registering for online banking (account number and PIN). Confirm your order by entering the TAN. You will receive confirmation of the transaction immediately afterwards. In principle, any Internet user can use SOFORT transfer as a payment method if they have an activated online banking account with PIN/TAN procedure. Please note that SOFORT transfer is not yet available at a few banks. If you choose the SOFORT transfer payment method, an additional charge of 0.0 percent of the purchase price will be incurred.

Giropay
You pay the invoice amount via your bank's online banking, which you will be redirected to during the ordering process. You log in as usual, e.g. with your account number and PIN, and authorize your payment e.g. with a TAN. Your bank must participate in the Giropay process.

If you select Giropay, you will be charged an additional 0.0 percent of the purchase price.

Cash on pickup
You can pay for your goods in cash upon collection.

5. Retention of title
The goods remain our property until full payment has been made.

The following also applies to entrepreneurs: We retain title to the goods until all claims from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you assign to us in advance all claims arising from this resale in the amount of the invoice amount - regardless of whether the reserved goods are combined or mixed with a new item - and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations.

6. Transport damage
If goods are delivered with obvious transport damage, please complain about such errors to the deliverer as soon as possible and contact us immediately. Failure to complain or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the freight carrier or transport insurance.

7. Warranty and guarantees

The statutory liability for defects applies. Information on any additional guarantees that may apply and their exact conditions can be found on the product and on special information pages in the shop.

8. Liability
We are always liable without limitation for claims based on damages caused by us, our legal representatives or vicarious agents.

in case of injury to life, body or health
in the event of intentional or grossly negligent breach of duty
in the case of guarantee promises, if agreed
insofar as the scope of application of the Product Liability Act is open.
In the event of a breach of essential contractual obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, the liability is limited to the amount of damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected.

Otherwise, claims for damages are excluded.

9. Final provisions
If you are an entrepreneur, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If you are a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us is our place of business in Thyrnau (Passau).
